4 things to Do, and 5 things not to Do if you get pulled over in Arizona for a DUI

Arizona has some of the toughest laws in the United States for Driving Under the Influence(DUI) so if you either live in Arizona or are planning to travel there it is a good idea to read this article and understand what you should do if you are pulled over for suspicion of DUI. We reached out to Arizona DUI Lawyer David Michael Cantor to get some Do’s and Don’ts in case you get pulled over.

DO:

  • Do Ask to speak with a DUI Lawyer in Arizona immediately!
  • Do show your drivers’ license, registration and proof of insurance.
  • Do ask to be released to obtain an independent blood test from a hospital.
  • Do behave courteously.

DON’T:

  • Don’t agree to take a Breath, Blood or Urine test until calling and talking with a DUI Lawyer in Arizona!
  • Don’t answer questions or agree to be videotaped.
  • Don’t take the eye test.
  • Don’t admit anything or take coordination tests.
  • Don’t try to talk your way out or be rude.

*These do’s and don’ts apply to most, but not all situations.

US constitutional rights give you the right to remain silent to prevent you from being coerced into making an incriminating statement. Arizona DUI Lawyers all agree that it is critical that you understand these rights and use them without faltering as most police officers are trained to take advantage of your lack of legal knowledge. Accepting eye or coordination tests puts you at the discretion of the police officers subjective analysis which can be very difficult to overcome in a court of law.

The fourth point under the Do’s section is very important as the police office has ultimate control of the situation. If you aggrivate them it can result in further charges being applied to your case. Be sure to give them your license, registration, and proof of insurance. After you give them these documents you should not give them anything else except for the ability to speak with a lawyer and to be released for independent blood test from a hospital.

If you follow these guidelines and remain courteous to the police officer you will have the best chance of over coming the charges in an Arizona court of law. Of course it is also best if you act responsibly and take a taxi home if you have been drinking within 2 hours of needing to drive.
